Welcome to Tranquir. These Terms of Service ("Terms") govern your use of the Tranquir mobile application ("App") operated by Jonkai Ventures OÜ ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Tranquir, you confirm that you:

• Are at least 16 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Agree to comply with all applicable laws and regulations

2. Description of Service

Tranquir is a sound healing application that provides:

• Real-time generation of healing frequencies (Solfeggio tones, binaural beats, etc.)
• Guided sound journeys and meditation experiences
• Frequency stacking and customization features
• Educational content about sound healing

3. Health Disclaimer

By using the App, you acknowledge and agree that:

• The frequencies and content provided are for general wellness and entertainment purposes
• You should consult a healthcare professional before using the App if you have epilepsy, seizure disorders, heart conditions, or are pregnant
• Binaural beats require headphones and may not be suitable for everyone
• You will not use the App while driving, operating machinery, or performing tasks requiring full attention
• We make no medical claims about the effectiveness of any frequencies

4. User Accounts

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

5. Subscription and Payments

5.1 Free and Premium Features

Tranquir offers both free and premium (paid) features. Premium features require a subscription.

5.2 Subscription Terms

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices are subject to change with reasonable notice

5.3 Cancellation and Refunds

• You may cancel your subscription at any time through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• Refunds are handled according to the policies of Apple App Store

6. Intellectual Property

All content in the App, including but not limited to:

• Audio frequencies and compositions
• Visual designs and animations
• Text, graphics, and logos
• Software code and algorithms

is owned by Jonkai Ventures OÜ or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

7. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or extract source code from the App
• Circumvent any access controls or usage limits
• Share your account credentials with others
• Use automated systems to access the App (bots, scrapers, etc.)
• Interfere with or disrupt the App's functionality
• Record, redistribute, or commercially exploit the App's audio content

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS

9. Indemnification

You agree to indemnify and hold harmless Jonkai Ventures OÜ and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jonkai Ventures OÜ regarding the App.
